An open work permit gives a foreign national the freedom to work for any Canadian employer for a set length of time. Some open work permits may limit the type of employment a foreign national can do or where they can work. An open work permit can be applied for from outside Canada, within Canada, or at a Canadian port of entry.
An open work permit may be awarded to the following individuals:
- An applicant who has no other source of income. (Foreign nationals who have no other source of income)
- Applicants for permanent residence who are currently residing in Canada. (Canadian Permanent Resident Applicants)
- For humanitarian reasons, foreign nationals are allowed to stay in Canada. (OPEN WORK PERMITS BASED ON HUMANITARIANISM)
- Canada Participants in the World Youth Program
- Student and young workers participating in international student and young worker exchange programs
- Exempted from the LMIA requirement are military personnel's family members and foreign representatives.
- A professional athlete who needs to work other jobs to support themselves while playing for a Canadian team is welcome to come to Canada.
- A resident who are the spouses of skilled workers
- Spouse of international students
- A foreign person currently in Canada with a work permit that is about to expire and who have applied for permanent residence under the following categories:
- The Federal Skilled Worker Program (Federal Skilled Worker Program) (FSWP)
- The Canadian Experience (CEC)
- A Program for Provincial Nominees (PNP)
- The Federal Skilled Trades Program (Federal Skilled Trades Program) (FSTP)
- Note that these workers are only eligible for an open work permit if they meet the program's eligibility standards.
- Foreign nationals who have applied for permanent residence in Canada under the spouse or common-law partner category (SCLPC). Applicants in this category will be eligible for an open work permit if they meet the following criteria:
- They have applied for permanent residence under the SCLPC category.
- The applicant's spouse/partner is a citizen or permanent resident of Canada.
- The applicant's spouse/partner has applied for sponsorship on his or her behalf
- The SCLPC applicant lives at the same address as the sponsor/spouse/partner
- The SCLPC applicant is a visitor, student, or worker with legitimate temporary resident status.
Unrestricted open work permits and occupation-restricted open work permits are the two types of open work permits.
A foreign national with an unrestricted open work permit can work in any job, for any company, in any location. Eligible workers who pass the medical exam will be given an open work permit with no restrictions. Unrestricted open work permits may also be granted to eligible workers who meet the following criteria:
- Have failed the medical exam AND have no other means of support (Applicant with No Other Means of Support)
- or are a member of a certain group of permanent resident applicants in Canada. (Canadian Permanent Resident Applicants)
An eligible worker with an occupation-restricted open permit can work for any employer, but the job they must do will be stated. Because occupation-restricted open permits are provided to eligible workers who have not completed a medical assessment, the employment limitation exists. As a result, holders of occupation-restricted open permits are rarely permitted to work in health-care-related occupations.If an eligible worker earns an occupation-restricted open permit and comes from a country where entering Canada does not need a medical check, he or she will be unable to work in the following occupations:
- Childcare
- Teaching in primary or secondary schools
- as well as health services
